The Use of Artificial Intelligence in Legal Practice

Recently, the Constitutional Court has set a historic precedent regarding the use of artificial intelligence in legal practice. Through ruling T-323 of 2024, the basic parameters for the use of generative artificial intelligence in judicial offices have been established. This decision has highlighted the rapid changes occurring in legal practice worldwide, making it imperative for various legal professionals to develop strategies to adapt to this new paradigm.

In this regard, it is vital for those of us who are dedicated to legal practice to identify areas of opportunity around the use of AI. By establishing clear guidelines and identifying the specific tasks that can be enhanced by AI, progress must be made on other tasks such as selecting the most appropriate technological tools for that purpose, advancing the training of professionals who know how to work effectively with artificial intelligence, calculating the costs and benefits of implementing these technologies, defining a sound strategy for risk mitigation, and setting clear metrics to identify when objectives have been achieved.

It is important to clarify that the enhancement of certain activities through AI must in no way result in the replacement of the human element. In the aforementioned ruling, the Court is emphatic in clarifying that AI cannot substitute the guarantee of a natural judge. Furthermore, the use of this tool must adhere to a series of fundamental principles, such as: (i) transparency and explanation, (ii) human control over decisions made by an AI system, (iii) safety, (iv) accountability, (v) non-discrimination, (vi) inclusion, (vii) the prevalence of the rights of children and adolescents, and (viii) social benefit.

One of the main strengths that artificial intelligence can provide is its ability to identify patterns and learn from them. Through the proper use of AI, a legal professional will be able to analyze a greater volume of data per unit of time, enabling more precise inferences to be made regarding various cases that come to their attention. This opens the possibility of reaching conclusions that would not have been attainable without the assistance of an artificial intelligence system.

However, it is crucial not to overlook the various risks involved in using artificial intelligence, such as the protection of personal data used in the process. Therefore, it is necessary to ensure that the technologies employed comply with globally accepted standards for personal data protection, such as Law 1582 of 2012 in Colombia or the GDPR regulatory standard. Respect for intellectual property rights must also be ensured, as well as adherence to minimum standards in cybersecurity.

In summary, the adoption of artificial intelligence tools in the context of legal practice presents a series of challenges and obstacles, but also offers a great opportunity to improve the efficiency and quality of the services provided. Its potential exceeds the mere drafting of rulings or communications and implies a greater capacity for information analysis. Therefore, a proper use of AI could result in a lower rate of judicial error and a more precise approach to case theories that better align with the interests of the different parties involved, ultimately contributing to a greater realization of justice in the social sphere.
